Event Host & Business Entity:  Roots Up Wellness

Please read this document carefully. By accepting this agreement electronically, you are waiving certain legal rights, including the right to sue Roots Up Wellness, its owners, instructors, employees, contractors, and event hosts/venues.

1. Description of Activities

I am voluntarily choosing to participate in events, retreats, workshops, or classes organized or facilitated by Roots Up Wellness. I understand that event activities may vary by location and program, and may include, but are not limited to:

• Physical movement, stretching, yoga, cardio, strength training, meditation, and breathwork practices.

• Group reflection, journaling, discussion, and goal-setting activities.

• Outdoor/indoor activities on varied venue terrains (including farms, nature properties, unpaved surfaces, or commercial facilities).

• Consumption of catered food, snacks, or beverages provided during events.

2. Assumption of Risk

I understand and acknowledge that participation in physical exercise, movement practices, outdoor/venue activities, and consuming provided meals carries inherent risks. These risks include, but are not limited to:

• Physical Injury: Muscle strains, sprains, slips, trips, falls, bodily injury, or aggravation of pre-existing health conditions occurring during movement, transportation, or navigation of venue grounds (e.g., uneven terrain, weather elements, insects, gravel, or unpaved paths).

• Dietary & Food Risks: Allergic reactions, foodborne illness, or adverse reactions related to consumed food or beverages. (Participants are solely responsible for disclosing severe dietary restrictions and allergies prior to the event).

• General Hazards: Property damage, loss, or theft of personal belongings.

I expressly, knowingly, and voluntarily assume all risks associated with my participation in all aspects of any Roots Up Wellness event, whether known or unknown, foreseen or unforeseen.

3. Master Waiver of Liability & Release of Claims (Under North Carolina Law)

To the fullest extent permitted under North Carolina law (including N.C.G.S. § 66-311 et seq.), I, on behalf of myself, my heirs, executors, administrators, personal representatives, and assigns, hereby release, waive, discharge, and hold harmless:

• Roots Up Wellness its owner(s), officers, managers, employees, independent contractors, agents, and volunteers;

• Elena Wigglesworth (in both individual and professional capacities);

• The Owner(s), Operators, and Lessors of any Venue or Property where Roots Up Wellness events are held;

(collectively referred to as the “Released Parties”) from any and all liability, claims, demands, causes of action, damages, costs, or expenses (including reasonable attorney's fees) arising out of or related to any loss, damage, injury, illness, or death that may be sustained by me, or to any property belonging to me, while participating in event activities or while on the premises where an event is conducted.

This release applies whether caused by the negligence of the Released Parties or otherwise, excluding gross negligence or willful misconduct as prohibited under North Carolina law.

4. Media & Photo Release Policy

I grant the Business the irrevocable right and permission to take photographs, audio, and video recordings of me during any Roots Up Wellness event or retreat.

I authorize Roots Up Wellness to use, publish, and distribute these materials for marketing, promotional, website, social media, and informational purposes without monetary compensation or prior review.

(If you do not wish to be photographed or recorded, you must notify Roots Up Wellness in writing prior to the start of the event).

5. Physical Fitness & Health Representation

I represent and warrant that:

• I am in suitable physical and mental condition to participate in event activities.

• I am aware of my own physical limitations and agree to modify or refrain from activities according to my comfort level and physical needs.

• I have disclosed or will disclose any severe food allergies to event organizers prior to attending.

6. Severability & Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina. If any provision of this agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

7. Electronic Signature & Acknowledgment

I acknowledge that I have read this release and waiver of liability agreement, fully understand its terms, and understand that I am giving up substantial legal rights, including my right to sue the released parties. By checking the agreement box and/or providing my typed name upon registration, I intend to sign this document freely and voluntarily.
